JUSTICE SANJAY PRIYA ORAL ORDER 3/ 21-03-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in Sessions Trial No.335 of 2016 arising out of Panchrukhi P.S. Case No.301 of 2015 instituted for the offence under Section(s) 364-A/34 Indian Penal Code.

Prayer of the petitioner for bail was earlier rejected by this Court by order dated 21.04.2017 passed in Cr. Misc. No.38180 of 2016 with liberty to renew the prayer for bail after nine months, if the trial is not concluded within the aforesaid period.

A report was called for from the Trial Court, which has been received, wherein, it is mentioned that the case is pending for defence evidence.

Patna High Court Cr.Misc. No.10100 of 2018 (3) dt.21-03-2018 2/2 Counsel for the petitioner has submitted that petitioner is in custody since 27.11.2015. Name of this petitioner has come in the confessional statement of co-accused, Pappu Singh, who has already been granted bail by order dated 09.08.2017 passed in Cr. Misc. No.30738 of 2017 by a coordinate Bench of this Court. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Siwan, in connection with Sessions Trial No.335 of 2016 arising out of Panchrukhi P.S. Case No.

301 of 2015, subject to the condition that both the bailors shall be close relative of the petitioner. The petitioner will co-operate in the trial and will remain present on each and every date of trial and will not cause delay in the trial. Absence of the petitioner on two consecutive dates without any reasonable cause will amount to cancellation of bail bond of the petitioner.
