JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-09-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor and perused the case diary. The petitioner is in custody in connection with Naubatpur P.S.Case No.205 of 2019 pending in the Court of Ist Additional Sessions Judge-cum-Special Judge, POCSO, Patna registered for an offence under Sections 354B, 376/511, 506 and 379/34 of the Indian Penal Code and Section 10 of the POCSO. As per prosecution case, this petitioner along with other co-accused persons misbehaved with the daughter of the informant while she was going to the temple for worship. It is further alleged that the accused persons including the petitioner tossed her down and tore her cloth but on hulla, they fled away from the place of occurrence. The petitioner has snatched her

It is submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case due to political rivalry as the petitioner was supporting the winner MLA against the candidate of prosecution party.

In view of the statement of the victim girl recorded under Section 164 Cr.P.C. and also specific allegation of physical assault of victim girl by the petitioner, I am not inclined to grant bail to the petitioner.

Accordingly, prayer for bail of the petitioner is rejected.
