Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Pirbahore P.S. Case No. 187 of 2021 instituted for the offences under Sections 25(1-B)a and 26 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 25.04.2021, charge-sheet has been submitted in the case and has antecedent of three cases. Learned counsel for the petitioner submits that the allegation is of recovery of a loaded country-made pistol and when the same was unloaded, two live cartridges were found.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of Ms. Akansha, learned Judicial Magistrate-I Class, Patna in connection with Pirbahore P.S. Case No. 187 of 2021 with a condition that one of the bailors shall be the wife of the petitioner Shikha Gupta.
