Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 18.09.2017 passed in Cr. Misc. No.41532 of 2017 with direction to the learned trial court to expedite the trial of the petitioner.
Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against the petitioner and in the meantime, the other accused persons having similar allegation have already been granted bail by a Co-ordinate Bench of this Court, vide order dated 23.11.2017 passed in Cr. Misc. No.45396/2017 and order dated 18.1.2018 passed in Cr. Misc. No.3560 of 2018 and the case of the petitioner is on better footing of the co-accused persons.
Patna High Court Cr.Misc. No.19788 of 2018 (2) dt.04-04-2018 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Lakhisarai in connection with S.C. (Sessions Trial) Case no.179 of 2017 arising out of Piri Bazar P.S.Case No.83 of 2016, with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
