JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 11-08-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 399, 400, 402, 307, 323, 322 of the Indian Penal Code and Sections 25(1-B) a, 26, 27, 35 of the Arms Act as well as Section 20/22 of the NDPS Act. There is recovery of 2.3 Kgs of Ganja from the house of co-accused Kanti Devi. The petitioner was apprehended along with other co-accused persons from the house of Kanti Devi.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.49183 of 2023(2) dt.11-08-2023 2/2 petitioner that petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern either with the accused persons or the seized contraband. The petitioner is languishing in custody since 24.04.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V-cum-Special Judge, NDPS, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 350 of 2022(NDPS Special Case No. 20/2022).
