JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is in custody in a case registered under Sections 147,148, 149, 120(B), 120(A), 122, 124(A), 307, 353 and 353 of the Indian Penal Code, 25(1-B)a, 26 and 35 of Arms Act, Sections 3, 4, and 5 of Explosive Substance Act and Sections 13, 16, 18 and 20 U.A.P. Act and Section 17 of Criminal Law Act. The informant came to know about the name of the petitioner on the basis of confidential information as well as conversation. Admittedly, neither the petitioner was caught at the spot nor any incriminating article has been recovered from the conscious possession of the petitioner.

The contention on behalf of the petitioner is that

No.42222 of 2015 (2) dt.15-09-2015 2/2 the father of the petitioner had filed a complaint case against the local police officials and that is the reason, the petitioner has been implicated in the present case. Further, it is pointed out that having more or less similar allegation one co-accused, namely, Nepali Yadav @ Nepal Ji @ Yugeshwar Yadav has been granted bail by a bench of this Court, vide order dated 21.01.2015 in Cr. Misc. No. 23507 of 2014.

Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Abhay Srivastav, Judicial Magistrate, 1st Class, Sherghati,Gaya, in Imamganj P.S.Case No. 131 of 2013, subject to the condition that the petitioner shall report Imamganj Police Station between 9 A.M. and 10 A.M. on the 1st and 3rd Sundays of every month. If he fails to do so, the court below shall be at liberty to cancel the bail bond of the petitioner.
