Petitioner apprehends his arrest in connection with Complaint Case No. 797 of 2010 in which cognizance has been taken under Section 406 of the Indian Penal Code. Allegation against the petitioner is that he got postal insurance account of the complainant opened in the post office and deposited Rs.7354/- and money has not been returned to him and petitioner is staff of the post office.

Submission of learned counsel for the petitioner is that earlier in this case final form has been submitted finding case not true and on protest petition cognizance has been taken.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Nawada, in connection with Complaintcum-Protest petition Case No. 797 of 2010, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
