The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 504, 506, 152 and 353 of the Indian Penal Code. The prosecution case is that one Raghubansh was dashed by tractor who subsequently declared dead by the doctor then the mob brought the dead body on the road and blocked the road. The alleged tractor was loaded with paddy was seized by the police when the mob tried to damage the tractor, misbehaved with the police personnel, raised slogan against the administration and thereby obstructed police in discharge of official duty.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.37714 of 2015 (2) dt.17-09-2015 2/2 petitioner that the accusation is against the mob and similarly situated co-accused persons have been granted anticipatory bail vide Cr. Misc. No. 30182 of 2015.
A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Karpi P.S. Case No. 49 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
