The petitioner seeks bail in connection with Basnahi P.S. Case No. 52 of 2021 instituted for the offences under Sections 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 02.06.2021 is a person with clean antecedent, charge-sheet has been submitted in the case and has antecedent of two cases and allegation is of looting the informant of Rs. 40,000/- and a mobile by three unknown criminals.
Learned counsel for the petitioner submits that the First Information Report is against unknown. The name of the
Patna High Court CR. MISC. No.58927 of 2021(2) dt.08-03-2022 2/2 petitioner transpired in the confessional statement of coaccused, Rahul Yadav. It is further submitted that though the petitioner is in custody but he was not put on T.I. Parade nor any incriminating article was recovered from his possession. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 02.06.2021, is a person with clean antecedent, chargesheet has been submitted in the case and name of the petitioner has come on the confessional statement of co-accused, Rahul Yadav, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Chief Judicial Magistrate, Saharsa in connection with Basnahi P.S. Case No. 52 of 2021, subject to condition that one of the bailor shall be the father of the petitioner, namely, Sri Gonu Yadav @ Gainu Yadav. (Satyavrat Verma, J) Jagdish/- U T
