JUSTICE SATYAVRAT VERMA ORAL ORDER 11-02-2022 Heard learned counsel for the petitioners and learned APP for the State through video conferencing. The petitioners seek bail in connection with Excise P. S. Case No.212 of 2021, instituted for the offences under Section 30(a) of the Excise Act, 2016.

The learned counsel for the petitioners submits that the petitioners are in custody since 07.08.2021, they are persons with clean antecedent and prosecution report has been submitted in the case.

Allegation is of recovery of 3017.520 litre of liquor from a truck as detailed in the F.I.R.

The learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.66596 of 2021(2) dt.11-02-2022 2/2 petitioner is neither the owner of the truck, nor the driver of the truck, nor the cleaner of the truck, but had taken lift and came to be implicated when search was made.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioners are in custody, they are persons with clean antecedent and prosecution report has been submitted in the case, the petitioners, abovenamed, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IInd-cumSpecial Judge of Excise Act, Gaya in connection with Excise P. S. Case No.212 of 2021.

The application stands allowed.
