2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. 22.200 litres of country made liquor has been recovered from co-accused persons.

4. It is submitted that nothing has been recovered from conscious possession of this petitioner or from his brickkiln. Petitioner has got no concern with the seized liquor or from the persons from whose possession illicit liquor were recovered. Petitioner has been made accused in this case simply because he is owner of the brick-kiln in question. Petitioner

5. Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. II, Siwan in connection with Excise Case No. 517 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
