2. Petitioner apprehends arrest in registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per prosecution case, 76 liters of country made liquor was recovered from Palani of the petitioner.

4. Learned counsel for the petitioner submits that recovery has been made from an open place which accessible to all. No incriminating material has been recovered from the conscious possession of the petitioner.

5. Learned A.P.P. for the State opposes the prayer for bail and submits that the petitioner has got one criminal antecedent of similar nature.
