This application has been filed by the petitioners for modification of order dated 14.09.2016 passed in Cr. Misc. No. 32244 of 2016, whereby petitioners were allowed anticipatory bail. One of the conditions therein was that they should surrender within six weeks from the date of the order. However, it is submitted that the petitioners could not surrender within the aforesaid period as they could not submit their bail bonds in view of the fact that there was delay in receiving antecedent report and,
Patna High Court Cr.Misc. No.6082 of 2017 (2) dt.22-02-2017 2 / 2 thus, petitioners seek extension of time for surrender. In the facts and circumstances of the case, this application is allowed.
Let the period of surrender as per order dated 14.09.2016 passed in Cr. Misc. No. 32244 of 2016 be extended by further four weeks from today.
It is made clear that in case the petitioners are found to be involved in any other case before 10.05.2016, save and except Kanahauli P.S. Case No.45 of 2016, in which they have not been acquitted of the charges as yet then they would be taken into custody.
