JUSTICE SATYAVRAT VERMA ORAL ORDER 10-03-2022 Heard learned counsel for the petitioner and Mr. Ram Bilash Roy Raman, learned A.P.P. for the State. The petitioner seeks bail in connection with Kudra P.S. Case No. 210 of 2020 instituted for the offences under Sections 394 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 16.09 2020, charges have been framed and has antecedent of two cases and the allegation is of looting mobile and Rs. 7,000/- from the informant and others by four unknown criminals, further when informant raised halla one criminal fired heating him on the left side of the waist.

Learned counsel for the petitioner submits that the First informant Report was against unknown and the name of this petitioner transpired in the confessional statement of Bhola Kumar, who has been granted bail by order dated 08.07.2021 passed in Cr. Misc. No.

Patna High Court CR. MISC. No.59599 of 2021(2) dt.10-03-2022 2/2 person, Raushan Kumar has been granted bail by order dated 07.07.2021 passed in Cr. Misc. No. 14252 of 2021. Learned counsel for the petitioner, thus, submits that persons whose confessional statement name of the petitioner transpired has been granted bail, as such, the petitioner also deserves to be released on bail. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 16.09.2020, charges have been framed and co-accused persons as aforesaid have been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM - VI, Kaimur at Bhabua in connection with Kudra P.S. Case No. 210 of 2020, subject to condition that one of the bailor shall be the father of the petitioner, namely, Mahendra Thakur and if the petitioner on two consecutive dates does not appear in the trial, the learned Court below shall forthwith cancel his bail bonds.
