Prayer for bail of the petitioners was earlier rejected by this court vide order dated 22.03.2022 passed in Cr. Misc. No. 49302/ 2021.
It is submitted that during trial victim Zaibun Nisha has been examined on 29.03.2022 but she has not supported the prosecution case. Similarly situated accused Shakil Rain has already been granted bail by a co-ordinate Bench of this court vide order dated 11.04.2022 passed in Cr. Misc. No. 51011/2022. Petitioners are in custody since 12.05.2021. Learned counsel appearing for the State opposes the
Patna High Court CR. MISC. No.50127 of 2022(2) dt.02-11-2022 2/2 prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Sheohar in connection with Mahila PS case No.06/ 2021 with the following conditions: - (I) The Petitioners/accused should not contact the prosecution witnesses or any person acquainted with the facts of accusation against them so as to dissuade them from disclosing the same to the Court or to the police.
(II) The petitioners/accused should cooperate the trail court in expeditious disposal of the trial against them. (III) The petitioners/accused should not contact the members of the prosecuting party as well as witnesses in this case in any manner till conclusion of the trial.
(IV) The petitioners/ accused should not repeat commission of similar offence in future and if they are found to be involved in commission of similar offence, the State is at liberty to apply for cancellation of bail granted to the petitioners in the instant case. (Prabhat Kumar Singh, J) BKS/- U T
