The petitioner seeks regular bail in connection with Bharachatti P.S. Case No. 204 of 2018 for the offences punishable under Section(s) 30(A) 38, 37 of Bihar Prohibition and Excise Act, 2016.

The allegation is regarding the recovery of 400 liters of illicit liquor from Swift desire vehicle.

The learned counsel for the petitioner submits that the petitioner is merely the driver of the said vehicle. Hence, he was not having the knowledge as to what was being carried in the said vehicle. It is further submitted that the petitioner has a clean antecedent and is languishing in custody since 19.03.2018. Having regard to the facts and circumstances of the case, the

No.30711 of 2018 (2) dt.22-05-2018 2/2 petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Court Excise Act, Gaya (Bihar) in connection with Bharachatti P.S. Case No. 204 of 2018.
