ANJANA PRAKASH ORAL JUDGMENT Date: 04-01-2016 The Petitioner seeks revision of the judgment of conviction dated 28.4.2006 passed by the 4th Additional Sessions Judge, Nalanda at Biharsharif in Criminal Appeal No.13 of 2006, by which he has modified the conviction of the Petitioner and sentenced him to one year R.I. with fine of Rs.1000/- under Section 25(1-B)a of the Arms Act and three months R.I. with fine of Rs.500/- under Section 26(i) of the Arms Act, in default of which simple imprisonment for another one month each, passed by judgment dated 31.1.2006 by the Judicial Magistrate, 1st class, Biharsharif in G.R. No.575 of 2005 (Trial No.1896 of 2005).
Having gone through the impugned judgment, I do not find any reason for interference. However, considering the date of occurrence, the sentence is modified to the period already undergone
Patna High Court CR. REV. No.485 of 2006 dt.04-01-2016 2/2 by him. However, he is required to deposit the fine as directed by the Court below within a period of eight weeks from the date of receipt of this order, failing which he shall be sentenced to imprisonment as directed by the court below.
With the aforesaid modification in sentence, the revision application stands dismissed.
