JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-12-2022 Heard Mr. Ram Sumiran Rai, learned counsel for the petitioner and Mr. Kumar Veerendra Narayan, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Bachhwara PS Case No. 283/2021 registered for the offence punishable under Sections 392 & 397 of the IPC. As per First Information Report, while the informant was driving his pickup van, he was accosted by two motorcycle borne miscreants who were joined subsequently, by two other miscreants. All the miscreants snatched a sum of Rs. 11,000/-, and one Mobile from the informant and fled away. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and he has falsely been implicated in this case on the basis of confessional statement of the co-accused, namely, Chhotu Kumar. He further submits that

It is further submitted that one similarly situated coaccused, namely, Kanhaiya Kumar Gupta has been granted bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 39302/2022.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that similarly situated co-accused, Kanhaiya Kumar Gupta vide Cr. Misc. No. 39302/2022 has already been granted bail by a Bench of this Court, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bachhwara PS Case No. 283/2021.
