Mr. Anil Kumar Singh No. 1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 12-10-2023 Heard Mr. Pramod Kumar, learned counsel for the petitioner and Mr. Anil Kumar Singh No.1, learned APP for the State.

2. The petitioner is apprehending his arrest in connection with Chandradeep P.S. Case No. 22 of 2022, F.I.R. dated 05.03.2022 for the offences punishable under Sections 386, 387/34 of the Indian Penal Code.

3. According to prosecution case, 12-15 unknown criminals including the petitioner jumped inside the Mill and started abusing and assaulting the informant and also took Rs. 20,000/- from his pocket and snatched mobile phones from all the labourers present there.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. He further submits that the petitioner is not named in the F.I.R and the name of the petitioner has been transpired on the basis of the confessional statement of the co-accused,

Patna High Court CR. MISC. No.49677 of 2023(3) dt.12-10-2023 2/2 namely, Bablu Kumar and except the confessional statement of the co-accused, no other material has come during investigation to suggest the involvement of the petitioner in the present occurrence.

The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that the petitioner and the co-accused persons have damaged the CCTV cameras which were installed at the place of occurrence and there is specific allegation against the petitioner that he was also involved in the present crime in question and apart from that the petitioner carries two criminal antecedents other than the present one.

6. Considering the aforesaid facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Chandradeep P.S. Case No. 22 of 2022 pending in the court of Additional Chief Judicial Magistrate , I, Jamui.

7. Prayer is refused.
