2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 302 and 120 (B) of the Indian Penal Code .

3 . As per the prosecution case , these petitioners along with other co-accused persons committed murder of sister of informant.

4. Learned counsel for the petitioners submits that informant is not eye witness to the alleged occurrence and only on suspicion they been made accused in this case . Petitioner No. 1 is devar and petitioner No. 2 is father-in-law of the

Patna High Court CR. MISC. No.50948 of 2024(4) dt.09-01-2025 2/2 deceased. They are separate in mess and property. There is no specific allegation is alleged against them and they have no concern with the affairs of the couple (deceased and her husband). Thrust of accusation is against the husband of the deceased who is already in custody . Petitioners claim clean antecedent.

5 . Learned counsel for the State oppose the bail petition .

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let this petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM - III Banka in connection with Dhoraiya P . S. Case No . 135 of 2024 , subject to the conditions laid down under section 438 of the Code of Criminal Procedure . (Prabhat Kumar Singh, J) Koushik/- U T
