JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have given Farsa blow causing head injury to the injured Amana Khatoon. The aforesaid injury was found grievous in nature by the doctor but submission on behalf of the petitioner is that the injured was examined by the doctor on 02.04.2015, i.e, just after the alleged occurrence and the said doctor found only one injury on the person of the injured and kept his opinion regarding the nature of injury reserved but subsequently, another doctor issued injury report on 09.04.2015 and the said doctor found three injuries on the person of the injured and all the injuries are said to grievous in nature. Learned counsel for the petitioner further submits that

No.36945 of 2015 (3) dt.03-11-2015 2/2 it is specific case of prosecution that the injured Amana khatoon sustained only one Farsa injury but it is surprising enough that three injuries were found on the person of the injured and all the three injuries are said to be grievous in nature. Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Dighalbank P.S.Case No. 34 of 2015.
