The petitioner is in custody since 29.04.2022 in connection with N.D.P.S. Special Case No. 21 of 2022 arising out of P.S. Case No. 62 of 2022 registered for the offence punishable under Sections 8, 20(b) (ii) (B) of the N.D.P.S. Act 1985.

Considering the fact that there is intermittent quantity recovery of Ganja i.e. 1.966 kg which is above small quantity and below commercial quantity and also the fact that the petitioner has clean antecedent, this bail application is allowed. In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, after framing of charge on furnishing bail bonds of

Patna High Court CR. MISC. No.48865 of 2022(2) dt.09-12-2022 2/2 Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court of Additional Sessions Judge-Vth-Cum-Special Judge, N.D.P.S. Khagaria in connection with N.D.P.S. Special Case No. 21 of 2022.

The petitioner will cooperate in the trial and will appear in the Court below regularly through his advocate or himself.

The petitioner will also mark the presence in rail Khagaria P.S. Case No. 62 of 2022 on the first Sunday of each month. Any default in appearance at the concerned Police Station would result in cancellation of bail bond of the petitioner.
