The petitioner seeks bail in connection with Dalshingsarai P.S. Case no. 306 of 2017 registered for the offence punishable under Sections 30(a), 38(i)(ii), 41(i) of Bihar Excise and Prohibition Act-2016.

6.804 lts. of foreign liquor is said to have been recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has no concern with the seized liquor. The house from where the aforesaid liquor is said to have been recovered, is inhabited by several other family members of the

Patna High Court Cr.Misc. No.16107 of 2018(2) dt.21-03-2018 2/2 petitioner. He was not apprehended on the spot. He has been languishing in custody since 23.12.2017. Though, one more criminal case has been lodged against the petitioner, but he is on bail in the said case.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-IIIcum-Special Judge (Excise Act), Samastipur in connection with Dalshingsarai P.S. Case no. 306 of 2017.
