JUSTICE SUDHIR SINGH ORAL ORDER 14-10-2015 Heard learned counsel for the petitioners and learned counsel for the State The petitioners are languishing in custody since 25.05.2015 in connection with Imamganj P.S. Case No. 58 of 2014 for the offences instituted under Sections 304(B)/34 and 120(B) of the IPC.

The prosecution story, in brief, is that the daughter of the informant, namely, Sarswati Devi (deceased) was married with Sujay Das on 24.04.2013 in accordance with Hindu rites and rituals. It is further alleged that at the time of marriage, the informant gave Rs. 75,000/- and several ornaments to Sujay Das. It is further alleged that the petitioners and other family members started torturing and due to non-fulfilment of Motorcycle, Sarswati Devi always explained her financial capacity and due to financial

Patna High Court Cr.Misc. No.40742 of 2015 (3) dt.14-10-2015 2/2 crunch she expressed her inability to fulfill the demand. The informant has further stated that due to non-fulfillment of demand of motorcycle, the petitioners and other co-accused persons threatened her and ultimately killed her.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioners are in custody since 25.05. 2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioners. The petitioner no. 1 is the father-in-law of the deceased and petitioner no. 2 is the mother-in-law of the deceased. They are separate in mess and property from the husband of the deceased. The husband of the deceased is in custody.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati, Gaya, in connection with Imamganj P.S. Case No. 58/2014.
