Petitioner seeks bail in a case registered under Sections 392, 395, 412 of Indian Penal Code.

It is submitted by the petitioner that he has falsely been implicated in this case alleging snatching of certain articles from the informant. He submits that though he is not named in the first information report, he has been implicated on the basis of statement of other co-accused who were arrested in course of investigation. The same has led to no recovery and other coaccused have been granted bail by this Court in Cr Misc No 10445 of 2017 and Cr Misc No 11720 of 2017. The petitioner is in custody since 01.04.2017.

Considering the submissions made on behalf of the

Patna High Court Cr.Misc. No.3201 of 2018 (2) dt.18-01-2018 2/2 petitioner, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sherghati, District - Gaya in Sherghati Police Station Case No 349 of 2016 subject to the following conditions:

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
