The petitioner seeks bail in a case registered under Section 354 of the Indian Penal Code and Sections 8 & 10 of POCSO Act.
Allegation is that the petitioner took the daughter of the informant in a village lane and started teasing her. It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.04.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due to previous enmity. It is further submitted that the petitioner may be released on bail after
Patna High Court CR. MISC. No.45505 of 2019(2) dt.23-07-2019 2/2 completion of five months in custody from 15.04.2019. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completion of five months in custody from 15.04.2019 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, POCSO Act, East Champaran, Motihari in connection with Kesariya P.S. case No.168 of 2019.
