Petitioner seeks bail in Khaira ( Nagra) P.S.Case No. 42 of 2020 registered for the offences punishable under Sections 396 of the Indian Penal Code and Section 27 of the Arms Act. As per prosecution case, while Sarwanand Mishra, brother of the informant was returning home after withdrawing Rs. 20,000/- from SBI, some unkown person snatched money and fired on him.

It is submitted on behalf of the petitioner that petitioner is not named in the F.I.R. The name of petitioner transpired during course of investigation. No looted articles has been recovered from possession of the petitioner. No T.I.P has

Learned APP for the State has opposed the prayer for bail of the petitioner and submits that the petitioner is having five cases of similar nature which manifests in Paragraph-3 of the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also period of detention of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Chapra, Saran in connection with Khaira ( Nagra) P.S.Case No. 42 of 2020.
