The petitioner apprehends his arrest in connection with Bheldi P.S. Case No.65 of 2022 instituted under Sections 399,402,414,413 IPC and 25(1-b)a/26/35 Arms Act. As per the prosecution story, the informant Police Officer alleged that in course of patrolling, he tried to apprehend some accused persons. While some of them managed to escape, two were apprehended who gave their names as Saurav Kumar and Bittu Kumar and from their possession, countrymade pistol and life cartridges as also mobile were recovered and further they disclosed the name of their associate, petitioner being one of them.

Further, the house of Pintu Sah and Md. Irfan were raided and stolen motorcycles were recovered. So far as this

Taking into account the fact that the petitioner do not have criminal antecedent, name has come in the confessional statement of the accused persons and nothing has been recovered from his house, this Court is inclined to grant him relief.

Let the petitioner be released on bail, in the event of his arrest or surrender before the Sub-ordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each in connection with Bheldi P.S. Case No.65 of 2022 to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
