2. The petitioner apprehends his arrest in connection with Complaint Case No.13358 (C) of 2022 registered for the offence punishable under Sections 498A, 323, 324, 307, 420, 506/34 of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act.
3. It is a very happy situation to see the parties happily standing together and they even intend to remain together in future.
4. It would appear that by the last order dated 18.03.2025, the petitioner had shown his desire to take his wife
Patna High Court CR. MISC. No.54430 of 2024(7) dt.24-04-2025 2/3 and keep her with full honour and dignity and today the Court is satisfied that the husband and wife are having a peaceful conjugal life.
5. In such view of the mater that the parties have resolved the disputes between them and have come to stay together, an appreciation needs to be recorded for the respective counsels who have made this situation possible.
6. In such view of the matter, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna in connection with Complaint Case No. 13358 (C) of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
7. However, just to keep a check, this Court feels that a liberty should be given to the wife to approach the courts by filing of an affidavit before the court below where the case is pending, in case the conduct of the petitioner is found wanting in some serious particulars. On such affidavit being filed, the learned court below would once again call the parties
Patna High Court CR. MISC. No.54430 of 2024(7) dt.24-04-2025 3/3 to the proceedings and see to it that the dispute is once again resolved and if not appropriate action be taken in accordance with law.
