The petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.
The widow of the deceased made specific allegation that while she was talking with her husband in front of her nursing home, Nitish Kumar and Manoj Kumar came on a scooter. Nitish Kumar fired on her husband causing his death and Manoj Kumar was driving the scooter. The petitioner was not named in the FIR. Name of the petitioner figured in the case as a suspect. Manoj Kumar confessed his guilt and disclosed that the petitioner was acting as a liner when he and Nitish had gone to commit murder. Considering the facts aforesaid and the fact that the

No.37256 of 2015 (2) dt.26-08-2015 2/2 petitioner is not the assailant of the deceased and during course of investigation his name came as liner, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Atul Sinha, the learned Judicial Magistrate, 1st Class, Patna in Parsa Bazar P.S. Case No. 79 of 2015.
