2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Amas P.S. Case No. 234 of 2023 instituted for the offence under Section 392 of the Indian Penal Code.

3. The case of the prosecution is that the informant was going to Pachma from his house on his bike. As he reached near a poultry farm, on a road going to Karmain More, three persons on a bike intercepted him and it is alleged that they took away his bike forcefully.

4. Learned counsel for the petitioner has submitted that the FIR was lodged against unknown miscreants. During course of investigation co-accused Ajay Kumar and Rishi both confessed about the guilt of the petitioner. Learned counsel

Patna High Court CR. MISC. No.48674 of 2025(2) dt.05-08-2025 2/2 further submits that nothing has been recovered from the possession of this petitioner. The petitioner is having criminal antecedent of one case in which he is on bail.

5. Learned APP for the State has vehemently opposed the bail application.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Amas P.S. Case No. 234 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, Sherghati, Gaya, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

7. Accordingly, the present bail application stand allowed.
