====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 08-01-2026 Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner seeks bail in a case initially registered for the offence under Sections-137(2) & 140(3) of B.N.S., 2023 in which, later on, Sections-8 and 12 of the POCSO Act was also added.

3. The prosecution allegation, in short, is that the petitioner enticed away the miner daughter of the informant.

4. It has been submitted on behalf of the petitioner that in her statement recorded under Section 183 of the BNSS, the victim did not support the prosecution case. She has stated in her statement recorded u/S 183 of the BNSS that without

5. On the other hand, learned counsel appearing for the informant has submitted that the petitioner had kidnapped the minor daughter of the informant.

6. Considering the aforesaid facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each of the satisfaction of learned District & Additional Sessions Judge-VII-cum-Special Judge (POCSO), Patna in connection with Spl. (POCSO) Case No. 138 of 2025 arising out of Bihta P.S. Case No. 98 of 2025 subject to the condition that the petitioner shall cooperate with the trial and make himself available as and when required by the court. (Nawneet Kumar Pandey, J) A.K.V.//- U T
