JUSTICE SUDHIR SINGH ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 399 and 402 of the Indian Penal Code and 25(1-b) (a), 26 and 35 of the Arms Act.
Allegation against the petitioner is that he along with other co-accused was making preparation to commit dacoity. On search one double barrel gun is said to have been recovered from his possession.
It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 14.5.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. As per prosecution case, one double barrel gun is said to have been recovered from his possession. No compliance of Section 100 of the Code of Criminal Procedure has been made. It is further submitted that petitioner may be released after completion of six months in custody from 14.5.2015.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of six months in custody from 14.5.2015 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Muffasil) P.S. Case no. 547 of 2015.
