JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 05-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks pre-arrest bail in connection with Supaul P. S. Case No. 743 of 2017 registered under Sections 363, 366-A, 120-B read with 34 of the Indian Penal Code and 4 and 5 of Children Marriage Restraint Act. It is submitted by the learned counsel for the petitioner that the victim has not made any allegation in her statement made under Section 164 of the Cr.P.C. except that the petitioner and others had taken away. The victim did not allege that she was physically abused or her modesty was outraged. It is submitted that as a matter of fact, the victim was having affair

Be that as it may, regard being had to the fact that the petitioner, who is reported to be a man of clean antecedent, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in Supaul P. S. Case No. 743 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
