The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 406/34 of the Indian Penal Code.

As per FIR, Rs. 9,90,091/ was kept in the locker after closing of two days, Rs. 7,88,285/- was missing from the locker of one branch of Saija Finance, a non-baking company. Learned counsel for the petitioner submits that the petitioner is manager of the bank. It would be manifest that on 11.01.2019 after locking the locker, the cashier gave the keys of the said locker to present petitioner Dharmendra Kumar and Anshuman Parasar. On behalf of the State, it is submitted that the petitioner is named in the FIR. There is specific allegation against the petitioner. The petitioner is custodian of the key of the locker of the bank. The co-accused has not been granted bail by the Coordinate Bench of this Court vide order dated 14.05.2019 in Cr. Misc. No. 19335 of 2019.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Kankarbagh P.S. Case No. 62 of 2019 from the Court of learned Judicial Magistrate-1st Class, Patna.

This application is accordingly dismissed.
