The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
It is a case of theft of motorcycle.
It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. It is further submitted that for the theft of the motorcycle of the informant Islampur P.S. Case No. 448 of 2019 was registered against unknown and the motorcycle of the informant was recovered near
Patna High Court CR. MISC. No.5528 of 2021(3) dt.29-08-2022 2/2 Amrudhiya Bigaha bridge in an abandoned condition. In the aforesaid case, the petitioner was made accused and on the basis of confessional statement of the petitioner, the petitioner has again been made accused in the present case. In Islampur P.S. Case No. 448 of 2019, the petitioner has already been enlarged on bail. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 1st, Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 179 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
