The petitioner seeks bail in a case registered under Sections 363/366(A) of the Indian Penal Code and 8 of POCSO Act.

Allegation against the petitioner is of kidnapping the daughter of the informant.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 29-05-2019. Charge sheet has already been submitted. The victim has been recovered. Her statement under Section 164 Cr.P.C. was recorded in which, she has denied the allegations made in the FIR. She has left home

Patna High Court CR. MISC. No.47567 of 2019(2) dt.31-07-2019 2/2 with her own sweet will. The victim has got married with the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-Ist- cum-Special Judge (SC/ST/POCSO), Bettiah, West Champaran in connection with Yogapatti P.S. Case No. 515 of 2018.
