The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of the C.L.A. Act.

The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. The petitioner was arrested on suspicion and he is said to have confessed his guilt. The name of the petitioner figured in the supervision note of the S.P. thereafter the petitioner is said to have confessed his guilt. Save and except the confession the I.O. did not collect any other tangible material to show the involvement of the

Patna High Court Cr.Misc. No.38245 of 2015 (2) dt.28-08-2015 2/2 petitioner. Similarly situated co-accused Dilip Sahni and Sujit Paswan have already been enlarged on bail.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Hajipur Sadar P.S.
