1. Heard Mr. Hansraj, learned counsel for the petitioner and Mr. Tapeshwar Sharma, learned APP for the State.

2. The instant petition has been filed for restoration of Cr. Misc. No. 13484 of 2024 which stood dismissed for default on 03.05.2024.

3. Learned counsel for the petitioner submits that non appearance of the petitioner's counsel on 03.05.2024 was not intentional and the petitioner was very much vigilant in pursuing his case despite he and his counsel could not have appeared in the fixed date and dismissal of the petitioner's case has caused sufficient loss to the petitioner.

4. Having considered the above submissions, Cr. Misc. No. 13484 of 2024 is directed to restore to its original

Patna High Court CR. MISC. No.55119 of 2024(2) dt.02-08-2024 2/2 position and original file.

5. The instant petition stands allowed.
