The petitioner seeks bail in connection with Special Case No. 21 of 2021 arising out of Baisi P.S. Case No. 78 of 2021 . instituted for the offences under Sections 8, 20(b) (ii) (c) and 25 of the NDPS Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.03.2021 is a person with clean antecedent, charge-sheet has been submitted in the case and the allegation is of recovery of 44.472 K.G. of Ganja from a Scorpio vehicle in which the petitioner was found sitting as codriver along with Vishwajeet Deo Verma. It is further submitted that petitioner being co-driver was completely unaware what

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner and submits that the allegation is of seizure of commercial quantity of ganja as such, he does not deserve bail.

Considering the submissions of the learned APP for the State that the alleged recovery is of commercial quantity of ganja, the court is not inclined to grant bail to the petitioner. It is accordingly, rejected.
