JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-11-2022 At the outset, the learned counsel for the petitioner submits that on account of typographical error in the prayer portion i.e. in paragraph no. 1, khata number has been wrongly mentioned as 257 instead of 357, hence he be permitted to correct the same. Permission so sought is granted. The necessary correction be made during the course of the day.

The present writ petition has been filled seeking the following relief:- "1. That this is an application for direction to the Respondent No. 1 to 4 to restrain Private

Patna High Court CWJC No.17519 of 2021(2) dt.03-11-2022 2/2 Respondents from encroaching the public land bearing Khata No. 357, Khesra No. 3025 under Revenue Thana No. 267 measuring about 5 decimals within the Kulti Village."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Asthawan Block, District-Nalanda, for redressal of her aforesaid grievance.

Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the Circle Officer, Asthawan Block, DistrictNalanda, by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith. The writ petition stands disposed off on the aforesaid terms.
