Petitioner seeks regular bail in Durgawati P.S. Case No.289 of 2017 instituted for the offence under Section 414/34 of the I.P.C.
Informant is the Sub Inspector of Police who has stated in his written complaint that while he was on night patrolling duty on 26.11.2017 he saw one motor cycle along with two persons and he asked the motor cycle to stop and after search no incriminating article was found either in possession of the petitioner or in the motor cycle. However, no ownership paper of the motor cycle was with the petitioner and on query they disclosed their names as Guddu Yadav and Atul Kumar and was taken into custody as no
Patna High Court Cr.Misc. No.2195 of 2018 (3) dt.08-02-2018 2/2 ownership paper was placed before them and there was apprehension that it was a stolen motor cycle and, as such, the said motor cycle was seized and both persons were taken into custody. It has been submitted by the petitioner that he was riding the motor cycle and the same belonged to co-accused Guddu Yadav and the petitioner is in custody since 26.11.2017 having no criminal antecedent.
Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Kaimur at Bhabua, in Durgawati P.S.Case No.289 of 2017.
