The petitioner seeks bail in a case under Section 379 of the Indian Penal Code.
The petitioner is not named in the FIR. The name of the petitioner figured in the case in paragraph 17 of the case diary in the confessional statement of co-accused, Sonu Kumar. The stolen motor cycle was recovered near a railway crossing. Nothing has been recovered from the possession of the petitioner. The petitioner has got no criminal antecedent.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in Bihar P.S. Case No. 287 of 2015.
