JUSTICE ARUN KUMAR ORAL ORDER 22-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Balua Bazar (Lalit Gram OP) PS Case No. 52 of 2017 registered under Section 394 of the IPC.

Submission is that the stolen motorcycle was not recovered from the possession of the petitioner rather recovery is from Dhananjay Kumar Mehta subsequent to the confessional statement made by Rohit Kumar and Dhananjay Mehta has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 62812 of 2017, moreover the petitioner has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Nitish Kumar Sharma @ Nitish Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Supaul in connection with Balua Bazar (Lalit Gram OP) PS Case No. 52 of 2017.
