The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 506, 379, 387, 427, 307, 436 of the Indian Penal Code.

The prosecution case in short is that on the date of occurrence, the accused persons came in the shop of the informant and demanded clothes as ransom. On protest, the accused persons abused the informant and went from there. After a while, the accused persons again came there and started Mar-Pit and also took out Rs. 40,000/- It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 05-04-2019. Charge

Patna High Court CR. MISC. No. 45865 of 2019(2) dt.24-07-2019 2/2 sheet has already been submitted. Allegation against the petitioner is of firing but none is said to have sustained injury in course of occurrence. No offence u/S 307 of the Indian Penal Code is made out. The petitioner has been made accused in the present case due to previous enmity. The other co-accused with similar allegation have been granted bail by this court as well as by a coordinate bench of this court vide orders dated 11-07-2019 and 17-07-2019 passed in Cr. Misc. Nos. 31683 of 2019 and 43820 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 160 of 2019.
