JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 02-02-2017 The petitioner has filed the present writ application for commanding the respondents to make payment of retiral benefits.
It would appear from the counter-affidavit filed on behalf of Accountant General, Bihar that authorities for postretiral dues, like, pension, commutative pension and gratuity have already been issued by the Accountant General. According to learned counsel for Accountant General, the payment on these authorities is to be made by the Treasury Officer, Danapur.
The State has also filed counter-affidavit wherein
Patna High Court CWJC No.12696 of 2016 (4) dt.02-02-2017 2/2 it has been stated that the petitioner has already been paid retiral dues under the head of group insurance, unutilized leave and general provident fund.
It is submitted by the learned counsel for the State that the payment of gratuity was not made to the petitioner only because certain amount was due against him which was subsequently paid and, accordingly, no dues certificate has already been issued by the Head Master-cum-Drawing and Disbursing Officer, Middle School, Lalkothi, Danapur and has been sent to the Treasury Officer, Danapur on 07.01.2017. In that view of the matter, I direct the petitioner to approach the Treasury Officer, Danapur for payment of gratuity amount and/or any other retiral benefits for which authorization has already been made by the Accountant General. In case the petitioner approaches the Treasury Officer, Danapur, he shall be obliged to release the payment to the petitioner within a period of ten days.
With the aforesaid observation and direction, the writ application is disposed of.
