Petitioner seeks bail in a case registered under Section 25 of the Arms Act.

Petitioner's counsel submits that in relation to the same allegations with respect to committing the murder of his wife by spade and being apprehended with a Deshi Katta, the petitioner has already been implicated in Bhore Police Station Case No 121 of 2017 which was lodged few hours earlier on the same very date and the instant case is the second first information report in relation to the same incident. He submits that in the earlier case, he is already in custody and that other than these two cases lodged after the said incident, there is no other case pending against the petitioner. Investigation has already been completed and the

Patna High Court Cr.Misc. No.3370 of 2018 (2) dt.19-01-2018 2/2 petitioner is in custody since 05.05.2017.

Considering the submissions made on behalf of the petitioner, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate XII, Gopalganj in Bhore @ Bhorey Police Station Case No 122 of 2017, GR No 1510 of 2017 subject to the following conditions: (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
