JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. It would appear from perusal of the first information report itself, that a quarrel took place between the parties on account of filling soil on a path and in that quarrel, petitioner no. 1 gave order to others to kill the deceased and, thereafter, one of the F.I.R named accused Rajesh Sah gave fatal blow to the deceased. So far as petitioner no. 2 is concerned, omnibus allegation of assault has been leveled against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of

Patna High Court Cr.Misc. No.42031 of 2015 (2) dt.15-09-2015 2/2 Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Chautarwa P.S. Case No. 105 of 2015.
