The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

Petitioner and other co-accused persons are alleged to have caught hold of Satyendra Prasad, husband of the informant Rita Kumari and Chander Kumar is alleged to have assaulted the deceased with spade and cut his neck. Satyendra Prasad died thereafter. Petitioner is alleged to have assaulted the informant Rita Kumari with spade but injuries found on the person of the Rita Kumari are simple in nature.

Learned counsel for the informant however, opposed the prayer for bail.

Patna High Court Cr.Misc. No.37056 of 2015 (2) dt.25-08-2015 P2/2 enlarged on bail. Petitioner is not the assailant of the deceased Satyendra Prasad.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bind P.S. Case No. 34/2015.
