====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 01-12-2021 Heard learned counsel for the petitioner and learned APP for the State.
Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a)(c)(d) of the Bihar Prohibition & Excise Act.

No.5646 of 2021(2) dt.01-12-2021 2/3 It is alleged that on receiving secret information regarding manufacturing and sale of illicit liquor in an old house by Pintu Kumar, Munna Kumar, Sachin Kumar and the petitioner, the police raided the house and seized 653.2 litres of illegal foreign liquor. The articles for manufacturing the liquor have also been recovered. It is submitted by learned counsel for the petitioner that recovery has been made from an abandoned house and only on the basis of suspicion, this false case has been registered against him. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions

No.5646 of 2021(2) dt.01-12-2021 3/3 Judge-II-cum-Special Judge (Excise), Aurangabad in connection with Excise Case No. 973 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C as well as subject to the following conditions: (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(b) Both the bailors shall be the resident of territorial jurisdiction of the learned court below. (c) The petitioner shall not leave the country without permission of the trial court.
